These Terms of Service ("Terms") govern your use of SideWRK Outdoors (the "Service"), operated by SideWRK Outdoors ("SideWRK Outdoors", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 and able to form a binding contract. You agree to provide accurate information and to keep your login credentials secure. You are responsible for activity under your account.
SideWRK Outdoors lets you manage customers and their equipment (small engines, outdoor power equipment, and powersports), build estimates and invoices, capture photos and documentation, send estimates for customer approval, record payments, and track your business. Features may change, improve, or be discontinued over time.
You can record payments by any method (cash, Venmo, Zelle, etc.) without a payment processor. If you enable card payments from your customers, those payments are processed by Stripe under Stripe's terms, and money flows from your customer to you โ we never hold your funds. SideWRK Outdoors is not a party to the transaction between you and your customer and is not responsible for disputes, chargebacks, refunds, or taxes related to your sales.
Don't misuse the Service. You agree not to: use it for unlawful, fraudulent, or harmful purposes; send spam, bulk, or unwanted messages; message anyone who has asked you to stop; attempt to breach security or access other accounts' data; reverse engineer or disrupt the Service; or use it to violate anyone's rights.
Accounts are subject to reasonable fair-use limits on media storage (currently about 25 GB per account, with a per-file limit of about 50 MB). We may ask you to reduce usage, or apply limits, if your usage materially exceeds normal individual use.
SideWRK Outdoors, its software, branding, and content are owned by us and protected by law. These Terms don't grant you any rights to our marks or software except the right to use the Service as intended.
For powersports equipment that has a VIN, optional vehicle-decode information comes from third-party sources such as NHTSA and is provided "as is." We don't guarantee its accuracy, completeness, or timeliness. Most equipment has no VIN and does not use this feature.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet any legal or regulatory requirement applicable to your business.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIDEWRK OUTDOORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
You agree to indemnify and hold SideWRK Outdoors harmless from claims, damages, and expenses arising out of your use of the Service, your business, your data, your messaging, or your violation of these Terms or applicable law.
You can stop using the Service and cancel anytime. We may suspend or terminate access if you breach these Terms or to protect the Service. If your subscription lapses, your data is retained for a limited period (currently about 90 days) so you can reactivate, after which it may be permanently deleted. You may request an export or deletion of your data subject to our retention practices and legal obligations.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state and federal courts located in California, unless applicable law requires otherwise.
We may update these Terms; we'll change the "Last updated" date and, for material changes, take reasonable steps to notify you. Continued use after changes means you accept them.
